Welcome to Nivenzo™ (www.nivenzo.app). By accessing, registering, or using our platform, you agree to these Terms and Conditions in their entirety. If you disagree with any provision, please do not use the service.

These terms constitute a legal agreement between you ("the User") and Arisneudy Santana Pozo, individual and owner of Nivenzo™ ("we", "our", or "the Platform"), domiciled in the Dominican Republic.

📋 1. Service description

Nivenzo™ is a cloud-based personal finance management platform that enables users to:

• Record and categorize income and expenses
• Create and manage monthly budgets by category
• Manage debts (credit cards, loans, mortgages) with amortization schedules
• Define savings goals with progress tracking
• Manage financial accounts (bank, cash, investments, savings)
• Schedule recurring payments with a financial calendar
• Generate reports and export data in PDF and Excel formats
• Share finances with a partner (shared accounts)
• Operate in multiple currencies (DOP, USD, EUR, and 40+ currencies)

The service is currently offered free of charge. We reserve the right to introduce paid plans or premium features in the future, which will be communicated in advance.

👤 2. Registration and user accounts

• You must be at least 18 years old to create a Nivenzo™ account.
• You can register via email and password, or through Google OAuth.
• You are solely responsible for maintaining the confidentiality and security of your login credentials.
• The information you provide must be truthful, accurate, and up to date.
• You must not share your account with third parties or allow unauthorized access.
• Any activity performed from your account is presumed to have been performed by you.

✅ 3. Acceptable use

By using Nivenzo™, you agree to:

• Not use the service for illegal, fraudulent, or rights-infringing activities.
• Not attempt to access, modify, or delete data belonging to other users.
• Not reverse engineer, decompile, disassemble, or modify the Platform's source code.
• Not automate access through bots, scrapers, or other unauthorized means.
• Not upload malicious content, viruses, malware, or harmful code.
• Not use the Platform to defame, harass, or harm other users.
• Not attempt to circumvent implemented security measures.

Violation of these rules may result in suspension or permanent deletion of your account, without prior notice and without right to compensation.

⚠️ 4. Financial data and disclaimer

• Interest calculations, projections, estimates, and analyses shown are for reference only and should not be the sole basis for financial decisions.
• Generated reports have no legal or accounting validity; they are personal reference tools.
• The user is solely responsible for the information entered into the platform, as well as for financial decisions made based on it.
• Nivenzo™ does not connect to real bank accounts or access banking credentials. All financial information is manually entered by the user.

We strongly recommend consulting a certified financial professional for important decisions about your finances, investments, or tax situation.

🔒 5. Intellectual property

All Platform content is protected by applicable intellectual property laws:

• Software: The source code, architecture, algorithms, and interfaces of Nivenzo™ are a protected work registered with the National Copyright Office (ONDA) of the Dominican Republic. All economic rights belong to Arisneudy Santana Pozo.
• Trademark: The name "Nivenzo", the logo, distinctive graphic elements, and visual identity are the exclusive property of Arisneudy Santana Pozo.
• Content: Texts, designs, illustrations, iconography, databases, and all material published on the Platform.
• Domain: The official domain www.nivenzo.app and all associated subdomains.

Without prior written authorization from the owner, it is strictly prohibited to:

• Reproduce, copy, distribute, or publicly communicate any Platform content.
• Use the Nivenzo™ trademark or associated visual elements for commercial or advertising purposes.
• Create derivative works based on the Platform's software or design.
• Systematically extract or reuse database content.

⚡ 6. Service availability and evolution

Nivenzo™ is a technology product in continuous evolution. This means:

• We may add, modify, improve, or discontinue features at any time without prior notice.
• The user interface, navigation flows, and features may change as part of the natural product improvement process.
• New integrations, APIs, or services may be added or removed according to product needs.
• We strive to maintain 24/7 service availability but do not guarantee uninterrupted access.
• We may perform scheduled maintenance that causes temporary interruptions.
• We are not responsible for losses resulting from service unavailability or changes in features.

🛡️ 7. Limitation of liability

To the maximum extent permitted by applicable law:

• Nivenzo™ is provided "as is" and "as available", without warranties of any kind, express or implied.
• We do not guarantee that the service will be free of errors, interruptions, viruses, or other harmful components.
• We are not responsible for financial decisions, economic losses, or damages of any nature based on Platform information.
• We are not responsible for data loss caused by circumstances beyond our reasonable control (force majeure, cyber attacks, third-party failures).
• Our maximum cumulative liability is limited to the total amount paid by the user for service use (currently zero, as it is free).
• We are not responsible for indirect, incidental, special, consequential, or punitive damages.

Nivenzo™ uses modern technologies and industry security standards:

🚪 9. Cancellation and suspension

9.1 By the user

• You can cancel your account at any time from the Settings section.
• Upon cancellation, your personal and financial data will be permanently deleted within 30 days.
• Encrypted backups are automatically deleted after 90 days.
• Cancellation is irreversible; data cannot be recovered once deleted.

9.2 By Nivenzo™

• We reserve the right to suspend or delete accounts that violate these Terms.
• We may restrict access if we detect suspicious, abusive activity, or activity that poses a risk to the Platform or other users.
• In case of suspension for violations, no indemnification or compensation will be granted.

📝 10. Modifications to these terms

We reserve the right to modify these Terms and Conditions at any time. When we make changes:

• Significant changes will be notified through the Platform, by email, or through a visible notice in the interface.
• The "last updated" date at the top of this document will be modified.
• Continued use of the service after publication of changes implies acceptance of the new terms.
• If you disagree with the new terms, you must stop using the service and proceed to cancel your account.

⚖️ 11. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Dominican Republic. Any dispute, controversy, or claim arising from these terms or the use of the Platform shall be submitted to the jurisdiction of the competent courts of the Dominican Republic.

Notwithstanding the above, we reserve the right to pursue legal action in any jurisdiction where infringements of our intellectual property rights have occurred.

💖 13. Voluntary donations

Nivenzo™ offers the option to make voluntary donations to support the development and maintenance of the platform. By making a donation, you agree to the following terms:

• Voluntary nature: Donations are entirely voluntary and do not grant access to additional features nor constitute a purchase of services. Nivenzo™ is and will remain a free platform.
• Payment processing: Donations are securely processed through PayPal. Nivenzo™ does not store credit or debit card data. The charge will appear on your statement as "PAYPAL *NIVENZO".
• Amounts: Donations have an allowed range of $1.00 USD to $500.00 USD per transaction.
• Currency: All donations are processed in US dollars (USD). If your local currency differs, PayPal will convert at the current exchange rate, which may result in an additional conversion fee from your bank.
• Receipts: You will receive an email receipt after each donation. You can also download PDF receipts from your donations panel.
• Refunds: Donation refunds may be requested by contacting arpozo.dev@gmail.com. Approved refunds will be returned to the original payment method (PayPal account or card) within 5-10 business days.
• Not tax-deductible: Donations to Nivenzo™ are not tax-deductible. Nivenzo™ is not a nonprofit organization.
• Use of funds: Donations are used to cover operational costs, development of new features, server maintenance, and platform infrastructure.

📜 14. General provisions

• Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Failure to exercise any right provided in these Terms does not constitute a waiver thereof.
• Entire agreement: These Terms, together with the Privacy Policy and Legal Notice, constitute the entire agreement between the user and Nivenzo™.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
